Terms of Purchase
1. Introduction
Parties: These Terms of Purchase ("Terms") apply to all individual agreements for the purchase of a Subscription Service and/or Digital Product entered into between the consumer or business customer completing the purchase (hereinafter the "Customer") and the Swedish private company SmakShare AB, corporate ID number 559353–6385 (hereinafter "SmakShare").
References to "you", "your" refer to the Customer. References to "we", "our" or "us" refer to SmakShare.
Subscription Service and Digital Products: Users of the SmakShare application (the "Application") may use it in the form of a paid subscription for a selected subscription period (the "Subscription Service"). We may also sell Digital Products to Users.
Acceptance: By completing the order, you confirm that you have read and accept these Terms of Purchase and undertake to comply with them.
2. Definitions
- Application: refers to the application "SmakShare" or "RecipeMind" for iOS and Android.
- Payment Service Provider: refers to a third party that processes payments from the Customer or performs invoicing on behalf of SmakShare.
- Digital Products: refers to digital products purchased from SmakShare, for example e-books or recipes.
- Subscription Service: refers to the Subscription Service purchased from SmakShare.
- Product Page: refers to a page in the Application with information about the price, characteristics, etc.
- Third party: refers to any party other than the Customer or SmakShare.
3. General terms of purchase
Age requirement
You must either (a) be at least 18 years old and have the right to independently enter into the purchase agreement, or, if you are a minor, (b) have obtained your guardian's consent. By completing the purchase, you confirm compliance.
Your details
You are responsible for providing correct contact and delivery details. We cannot be held responsible for incorrectly provided details.
Price
The price for the purchase is shown before the order is completed.
Payment
You are responsible for ensuring that the account to be debited belongs to you and contains sufficient funds.
If you complete the purchase through Apple's or Google's in-app payment solution, all debiting and transaction handling is handled by Apple or Google. The purchase is then governed by their terms and we cannot issue refunds. All refund questions are handled by Apple or Google.
If you purchase through our website and/or via Stripe's payment page, the purchase and refunds are handled by us.
Delay in payment
The Customer is in default if payment is not made on time. In such case, we are not obliged to provide the Subscription Service or Digital Product. We may choose between demanding payment and terminating the agreement.
Order confirmation
The order confirmation contains information about the purchased service/product. If you discover any error, contact us immediately at info@smakshare.se.
Discounts, offers and campaigns
Discounts cannot be redeemed for cash or combined with other offers, unless expressly stated otherwise. Discount offers are valid for a limited time.
Payment Service Provider
You accept the Payment Service Provider's terms when you make a payment via their service. You are responsible for reading their terms before completing the purchase.

If you have questions about the Subscription Service or Digital Products, contact our customer service. Details are provided at the end of these Terms (section 16).
4. Purchase of Subscription Service
4.1. Subscription periods
We provide a monthly or yearly ongoing subscription.
4.2. Free trial period
We may offer a free trial. A binding subscription agreement is entered into at the start date of the free trial period. If you do not cancel before the end of the trial, the selected subscription period will commence and you will be charged.
4.3. Payment terms
Payment for the monthly subscription is made monthly in advance. Payment for the yearly subscription is made yearly in advance. The subscription fee is paid by debiting the bank account you registered via App Store, Google Play or Stripe.
4.4. Term and termination conditions
You have the right to terminate the subscription at any time. If you terminate during the subscription period, the subscription will end after the current period. Termination is done via Stripe, App Store or Google Play. No refund of already paid fees will be made.
We reserve the right to terminate the Subscription Service at any time with 30 days' notice.
4.5. Automatic renewal
Monthly: If not terminated, it will automatically renew on the same billing date of the following month.
Yearly: The yearly subscription runs with a commitment period of 12 months. If not terminated, it will automatically renew with an additional 12-month commitment period.
4.6. Price adjustment
We have the right to change the subscription fee by informing you no later than 30 days before the change takes effect. If you do not accept the price adjustment, you may terminate the subscription.
4.7. Delay in payment
In case of late payment, we may terminate the agreement or limit your access until full payment is made. Non-payment is not accepted as termination.
5. Purchase of Digital Products
Purchases may be made via the Application, our website and/or in another manner. Payment is made through available payment methods. Delivery takes place digitally when payment has been completed.
6. Right of withdrawal
The Swedish Distance and Off-Premises Contracts Act contains provisions governing consumers' right of withdrawal for purchases made at a distance. The withdrawal period is 14 days from the date of the agreement.
To withdraw an order, notify the provider of the platform you used (Apple or Google). If purchased via Stripe, withdraw by emailing info@smakshare.se. Subscriptions can only be cancelled within the withdrawal period of the first subscription period.
6.1. Special conditions for Digital Products
According to the Distance and Off-Premises Contracts Act, the right of withdrawal does not apply to digital content supplied other than on a physical medium if the supply has begun and the consumer has consented. By completing the purchase, you expressly consent to immediate supply and accept that there is no right of withdrawal.
7. Complaints (Reklamation)
Any defects must be reported to info@smakshare.se. A complaint made within two months from when you noticed the defect is considered timely.

In the event of defects, the Customer may demand rectification, re-delivery, a price reduction, or terminate the agreement. The Customer may also claim damages or withhold payment.
8. Intellectual property rights
We or our licensors own all intellectual property rights related to the Digital Products. You may not copy, reproduce or commercially exploit our intellectual property rights without prior written consent. A breach is considered a material breach of contract.
9. Privacy Policy
We process your personal data in accordance with the GDPR. More information can be found in our Privacy Policy.
10. Notices
You agree that we may provide information via email or another appropriate manner to the contact details you provide.
11. Assignment
We have the right to assign the purchase agreement, in whole or in part, to other companies or third parties without your consent. You may not assign any rights or obligations.
12. Invalidity of provisions
Should any provision be found invalid, this shall not affect the validity of the other provisions.
13. Survival of provisions
Provisions regarding intellectual property rights, dispute resolution and provisions intended to apply after termination shall continue to apply.
14. Changes
We reserve the right to make changes to our terms, including prices and payment terms. Material changes will take effect at least 30 days after we have informed you. Continued use constitutes acceptance. These terms apply from 8 October 2025.
15. Applicable law and disputes
The Terms shall be interpreted in accordance with Swedish law. Consumers have the right to turn to the National Board for Consumer Disputes (ARN, www.arn.se) or the European Commission's Online Dispute Resolution platform.
